Real estate: what recourse is there against the sale of an over-valued, energy-guzzling property?

At a time when the Energy Performance Diagnostic (DPE) has become a major issue, numerous disputes are emerging around property transactions due to inaccurate DPEs. In an interview with Les Echos, our partner Frédéric Coppinger highlights the complexity of the procedures for cancelling a sale when the diagnosis proves to be faulty.

Frédéric explains that the annulment process can take from one to four years and entail various consequences, such as the reimbursement of work already undertaken, rental losses and financial costs linked to loans.

Although case law is evolving and judges are paying increasing attention to these issues, proving the seller's bad faith remains a major challenge.
